An application for interlocutory injunction on the public screening of a video allegedly detailing judicial bribery has been withdrawn.
The case was scheduled to be heard today, September 22, 2015 but when it was called, lawyers for the applicants withdrew it after request for adjournment was turned down by the request.
Lawyer for Justice Paul Uuter Dery, one of 12 High Court judges captured on video allegedly taking bribes, brought the application last week.
Nii Kpakpo Samoa Addo argued the screening of the video would prejudice his client’s right to fair hearing.
He therefore wanted managers of the Accra International Conference Centre which has been advertised as venue for the screening to be restrained from allowing Anas Aremeyaw Anas access to the facility for purposes of screening the video.
When the case was called, the lawyer asked for time to study a response filed by the Attorney-General.
But the trial judge, turned down the request, saying the today, September 22, has been advertised for the premiering of the video and it was only fair that the matter was determined today.
The lawyer had moved an ex parte motion for substituted service, saying all attempts to serve the writ of summons on Anas and Tiger Eye PI had failed since they could not be located at known addresses.
The court granted the applicants to serve the defendants by posting notices of the writ on the noticeboard of the court and other public places.
Lawyer, Nii Kpakpo told Myjoyonline that even though his client has withdrawn his application for interlocutory injunction against Tiger Eye PI has been withdrawn, one has been filed against managers of the conference centre and same has been served on them.
He said this operates to stop the Centre from allowing Anas and Tiger Eye PI to screen the video there later today.
Anas’ lawyer, Mr. Kissi Adjabeng, however, maintains his client “has a contract with them for the premiering; the place booked and paid for”.
Justice Dery has been waging a relentless against Tiger Eye PI, filing an avalanche of cases the company and its founder, Anas.
He is seeking to stop the screening of audio-visual recordings showing judges allegedly trading justice for money and goats.
Justice Dery is also challenging the legality of the recordings, insisting they were made in violation of his right to privacy and, therefore, cannot be used as evidence against him in any impeachment proceedings.
